Terms of Service

1. General Provisions

These Terms of Service define the rules for using the web service (the "Service") provided by Tomasz Miller (the "Provider"). The Service comprises two products under one account:

The Service is operated by Tomasz Miller as an unregistered business under Polish law. Contact — including complaints — is available exclusively via the contact forms in Santa's Sack.

Using the Service means accepting these Terms. If you do not agree, stop using the Service.

Signing in to either trusted product may authenticate the current browser in both. Signing out of either product signs the browser out of both.

2. Definitions

  • User — a natural person using the Service.
  • Service — Santa's Sack and Gifts together, under one account.
  • Content — data, texts, links or other materials provided by Users.
  • Account — the individual User account shared by both products.
  • Access phrase — the human secret that, together with an unguessable Gifts share URL, unlocks read access to a list. A six-digit PIN is not used as the sole secret.

3. Terms of Use of the Service

3.1. Registration and Account

  • Full functionality requires an account with a valid e-mail address. Sign-in uses a one-time e-mail code issued by Santa's Sack.
  • The User is responsible for keeping access to that mailbox confidential.
  • The User may delete the Account at any time from Santa's Sack or Gifts.

3.2. User Rights and Obligations

The User undertakes to:

  1. Use the Service in accordance with applicable law and these Terms.
  2. Not provide offensive content, content infringing third-party rights, or content contrary to good practices.
  3. Not disrupt the Service (for example DDoS or unauthorised access attempts).
  4. Respect the privacy of other Users, including Gifts redaction rules: other givers must not be shown who reserved which gift or who declared how much.

The User has the right to access their Account and data and to delete the Account at any time.

3.3. Santa's Sack — gift exchanges

  • Santa's Sack enables secret gift exchanges in groups.
  • Users are responsible for fair participation and group rules (for example price limits).
  • Disputes between Users should be resolved between them. The Provider is not responsible for the course of an exchange or claims between Users.

3.4. Gifts — lists, sharing and coordination

  • A new Gifts list is private until the owner creates a share link or invitation.
  • Every shared list is gated by an unguessable URL and an access phrase. Unlocking with the phrase is read-only. Reserving a gift, declaring an off-platform transfer, or commenting requires a signed-in verified account. Share access never grants the right to edit the list or its items.
  • Transfer declarations record money moved outside Gifts (for example a bank transfer). They are a coordination record, not a payment processed by the Service and not a donation through the Santa's Sack support widget.
  • The list owner sees who reserved or bought which gift and who declared how much. Other givers see only that an item is taken or bought, and only an aggregate budget bar.

3.5. Fees and voluntary support

  • The Service is free to use.
  • Users may voluntarily support operation of the Service through the donation widget in Santa's Sack after signing in. Those payments are voluntary, are not a fee for the Service, and do not guarantee extra features.
  • Gifts contribution declarations are not donations and not in-app payments.

3.6. Service Availability

  • The Provider may discontinue the Service at any time. Where reasonably possible, Users will be notified in advance.
  • The Provider may introduce limits to prevent overload or abuse.
  • Maintenance windows may occur. Lack of continuity is not a claim for payment or an SLA.

3.7. Force Majeure

  • The Provider is not liable for unavailability caused by events beyond reasonable control (natural disasters, infrastructure failures, cyberattacks, strikes, government action, and similar).
  • The Provider will try to restore the Service but does not guarantee a timeline.

4. Intellectual Property Rights

  • The Service and its elements (source code, interface, graphics, logo) are owned by or licensed to the Provider.
  • The User does not acquire ownership of those elements.
  • Content published by Users remains their property. The User grants the Provider a non-exclusive, royalty-free licence to use that content as needed to operate the Service (storage and display to authorised Users).

5. Reporting Violations (Notice & Takedown)

  • Copyright or other IP complaints may be sent via the contact form or e-mail, with a description, a link to the content, contact details, and whether the report is on one's own behalf.
  • The Provider will consider removing or blocking disputed Content as soon as reasonably possible, in accordance with law.

6. Liability

  • The Provider does not guarantee uninterrupted, error-free operation.
  • The Provider is not liable for force majeure or external failures; losses from improper use; or User Content (Users are responsible for its legality).
  • To the maximum extent permitted by law, liability is limited because the Service is free.

7. Data Retention and Account Deletion

  • After Account deletion, data visible in the Service interface is removed within 30 days, unless law or technical grounds require longer retention.
  • Deleting the account from Santa's Sack or Gifts immediately revokes Gifts share links and invitations, removes list memberships, and signs the browser out of both products. Owned gift lists are kept and return as private lists if the User later signs in again.
  • Backups may be kept no longer than 90 days after deletion, for administration and possible restoration.
  • Longer retention is limited to legitimate interests such as claims, not exceeding statutory limitation periods.
  • The User may request a portable export (for example JSON) before deletion if technically feasible.

8. Minors and donations

  • Use by persons under 18 is permitted, but donation contributions through the Santa's Sack widget require parental or guardian consent.
  • Gifts transfer declarations are not donations; they still require a verified account.
  • The Provider may limit donations from minor Users to prevent abuse.

9. Changes to the Terms

  • The Provider may change these Terms.
  • Users will be informed of significant changes at least 14 days before they take effect, by e-mail or in-Service notice.
  • Continued use after that date means acceptance of the new version.

10. Complaints and Claims

  • Contact via the contact form or e-mail.
  • Complaints are handled within 14 calendar days.
  • Include the Account e-mail, a description, the date, and optionally a group, list or operation identifier.

11. Applicable Law and Dispute Resolution

  • These Terms are subject to Polish law.
  • Disputes will be resolved by the common court competent for the Provider's or User's place of residence, as applicable.
  • Consumer rights under mandatory law are not limited.
  • Consumer Users may use the EU ODR platform.

12. Final Provisions

  • If any provision is invalid, the remaining provisions stay in effect.
  • Polish law applies to matters not regulated here.
